These terms apply to every Burgess Auctions LLC firearms auction, whether you bid in person, live online or in a timed online sale. By registering or placing a bid, you agree to them.
Burgess Auctions LLC · Indiana Auctioneer License #AU19600029 · FFL #4-35-139-01-9H-11627 (Type 01 Dealer)
Firearms transfer location: 5 S. Main Street, Carthage, IN 46115 · Office: 45 W. Carey Street, Knightstown, IN 46148 · 765-445-7814
1. Acceptance of Terms
By registering, bidding or buying in any Burgess Auctions LLC firearms auction, you agree to these Terms and Conditions. They apply no matter which platform you bid on, including bidburgess.com and any other platform where the auction is listed. Terms posted on an individual auction listing are part of these terms; if the two conflict, the auction listing governs.
Registering at bidburgess.com keeps your registration, invoice and transfer paperwork in one place, handled directly by our team.
2. Bidder Eligibility & Registration
You must be at least 18 years old to bid on long guns (rifles and shotguns) and at least 21 years old to bid on handguns and handgun frames or receivers. By registering, you confirm that:
- You are legally allowed to buy and possess firearms under federal, state and local law.
- You are not a prohibited person under 18 U.S.C. § 922(g).
- You will complete ATF Form 4473 and a NICS background check as federal law requires.
- You will follow all laws that apply to buying, transferring and possessing the items you win.
Registration requires a valid government-issued photo ID, a current address and a phone number. The same person who registers and wins is the only person who may complete the transfer. Burgess Auctions LLC may refuse registration or bidding privileges to anyone at its sole discretion.
FFL holders bidding under their license must send a current copy of their FFL before bidding.
3. Buyer's Premium
A buyer's premium is added to the hammer price of every lot:
How you bid | Buyer's premium |
|---|---|
In person at the auction | 15% |
Online, on any platform | 20% |
The buyer's premium is non-negotiable and is refunded only for a verified cataloging error by Burgess Auctions LLC.
4. Payment Terms
Payment in full is due when you receive your invoice and no later than 5 business days after the auction closes. Pay through your Burgess Auctions bidder account, in person, or by phone at 765-445-7814.
Accepted payment:
- Cash (in person)
- Visa, Mastercard and Discover (no American Express)
- Cashier's check or bank wire
- Personal checks from Indiana residents, at our discretion. We may hold items until the check clears.
Certified funds (cash, cashier's check or wire) are required for any lot shipping out of state with a hammer price over $1,500, and may be required on any lot at our discretion. A $50 fee applies to any returned check.
Payment discounts (they can be combined):
- 3% off when you pay in cash.
- 1% off when you pay within 24 hours of your invoice being issued.
5. Sales Tax
Indiana sales tax of 7% is charged on purchases unless a valid, current Indiana ST-105 exemption certificate is on file before invoicing. Out-of-state FFL dealers buying for resale should send their resale or exemption certificate with their FFL.
6. Background Checks & In-Person Transfers
Every firearm transfer follows federal law. Only the registered winning bidder may complete the transfer and take possession. No exceptions.
In-person pickup takes place at 5 S. Main Street, Carthage, IN 46115, by appointment. To take possession you must:
- Pay your invoice in full. Background checks are run only after payment is received.
- Bring the same government-issued photo ID used to register.
- Complete ATF Form 4473 in person.
- Pass the NICS background check. We run it at no charge.
Who can pick up in person: Indiana residents may take possession of handguns and long guns. Out-of-state residents may take possession of long guns in person only where legal in both Indiana and their home state. Handguns sold to out-of-state residents must ship to an FFL in the buyer's home state (Section 7).
Delayed or denied checks: A NICS delay is not a denial. We will hold the firearm for the period federal law allows, which can run up to 10 business days for buyers under 21. If a check is denied, the sale is void, the firearm will be resold, and the buyer's premium is not refunded.
7. Shipping Firearms (FFL to FFL)
Modern firearms that are not picked up in person ship only to a licensed FFL dealer. We cannot ship a firearm directly to a buyer under any circumstances, and we do not ship internationally.
- Pay your invoice in full.
- Choose an FFL dealer in your state of residence. Most local gun shops do transfers; call ahead to confirm they accept transfers and ask their fee.
- Email a copy of your dealer's current, signed FFL to [email protected] with your full name as registered and your invoice number.
- Allow up to 14 days after we receive the FFL for processing and shipment.
- Our shipping partner, Shipping Saint, will send you a separate invoice for shipping. Your firearm ships once that invoice is paid.
- Your FFL receives the firearm and completes the Form 4473 and background check with you.
All firearm shipments are fully insured and require an adult signature. Firearms going to the same FFL can be combined; each different FFL is a separate shipment. The buyer pays any fee charged by the receiving FFL. If your FFL refuses the transfer or its license is invalid, you must provide another FFL.
8. FFL Deadline: Our 7-7-7 Policy
Send your FFL information promptly. For buyers who don't:
- Day 7: We call and/or email a reminder.
- Day 14: We mail a certified letter as final notice.
- Day 21: If we still have no FFL, the firearm is forfeited and resold. No refund is issued.
9. Black Powder, Antique Firearms & Air Guns
Muzzleloaders and antique firearms meeting the federal definition in 18 U.S.C. § 921(a)(16), along with air guns and BB guns, are not "firearms" under the Gun Control Act. Once paid in full, they may ship directly to the buyer:
- The buyer must provide a government-issued photo ID showing they are at least 18.
- We may require FFL-to-FFL shipment of any item if its classification is in question or the buyer's state or locality requires it.
- The buyer is responsible for confirming the item is legal to own where they live.
10. Ammunition, Magazines & Accessories
- You must be 18 to buy rifle and shotgun ammunition and 21 to buy handgun ammunition.
- Ammunition ships by ground only and cannot ship to states or localities that restrict direct ammunition sales.
- Magazines and accessories cannot ship where they are restricted by state or local law.
- Non-firearm items ship directly to the buyer through Shipping Saint, billed on a separate shipping invoice.
11. State & Local Restrictions
Some states, counties and cities restrict certain firearms, calibers, magazine capacities, ammunition and accessories. It is the buyer's sole responsibility to know those laws before bidding. Burgess Auctions LLC does not give legal advice. If an item cannot lawfully ship to your location, we will work with you on alternatives, but no refund is issued because an item is not legal where you live.
12. Condition & Warranty
All items are sold AS IS, WHERE IS, with no warranty expressed or implied, including any warranty of merchantability or fitness for a particular purpose.
- Descriptions, photos and condition notes are provided as a courtesy and are not a warranty.
- Preview times are posted on each auction listing. We encourage you to inspect items, or have a gunsmith inspect them, before bidding.
- All sales are final. There are no returns or refunds except for a verified cataloging error by Burgess Auctions LLC.
13. NFA Items
Burgess Auctions LLC is not a Class 3/SOT dealer and does not sell items regulated under the National Firearms Act, such as suppressors, short-barreled rifles or shotguns, or machine guns.
14. Failed Transfers & Straw Purchases
If the winning bidder cannot legally take possession for any reason, no refund is issued except as stated in Section 6. Any attempt to transfer a firearm to someone other than the registered winning bidder, or to get around NICS or FFL requirements, will result in immediate cancellation of the sale, forfeiture of payment and a ban from future Burgess Auctions LLC events.
15. Removal & Storage
Paid items must be picked up or have shipping arranged within 7 days of the auction. Removal times are posted on each auction listing. After 7 days, storage fees may apply, and items left without arrangements may be treated as abandoned at our discretion.
16. Damaged or Lost Shipments
Inspect your item as soon as it arrives at your FFL or your door. Photograph any damage to the packaging and the item, and contact us within 24 hours. We and Shipping Saint will help you file a claim with the carrier. If tracking shows delivered but your FFL can't find it, check with the FFL first, then contact us so we can start a trace.
17. Auction Conduct
The auctioneer may reject any bid, settle bidding disputes, withdraw any item, and group or divide lots. The auctioneer's decision is final in all matters of auction conduct. Catalog errors are corrected as they are found.
18. Technical Issues
Burgess Auctions LLC is not responsible for internet outages, platform failures or bidding delays. If a verified technical failure on our end or our platform affects bidding, we may extend bidding, reopen a lot or void a sale at our discretion.
19. Liability
Bidders assume all risk of injury or loss while attending or taking part in any auction, in person or online. Burgess Auctions LLC is not responsible for accidents, injuries or losses at the auction facility. By bidding, you agree to indemnify and hold harmless Burgess Auctions LLC, its agents and employees from any claim arising from the purchase, possession, transfer or use of any item sold.
20. General Terms
- All federal, state and local firearms laws will be followed.
- If you register through another bidding platform, you allow Burgess Auctions LLC to use the registration information from that platform to complete your purchase, meet legal requirements and send you future auction notices.
- Failure to follow these terms may result in cancellation of the sale, loss of bidding privileges or legal action.
21. Binding Agreement
By registering, bidding or buying in any Burgess Auctions LLC firearms auction, you confirm that you have read, understand and agree to these Terms and Conditions in full.
